Albuquerque man who just got out of prison is arrested again
ALBUQUERQUE, N.M. (AP) — A man sent to prison for shooting at neighbors' homes in Albuquerque has been arrested.
Albuquerque police say a probation officer checked on 31-year-old Derek Foote on Friday and an assault rifle was found under a blanket on Foote's bed.
Authorities tell KRQE-TV that Foote now is being charged with being a felon in possession of a gun and is facing a parole violation.
In court Saturday, a judge told Foote the state has filed a motion to keep him locked up until he goes to trial for the new charge.
Foote just got out of prison a few weeks ago after serving a six-month sentence for shooting at occupied structures in 2016.
As part of Foote's sentencing last December, two years of his prison term were suspended.
