Kazakhstan supports amendments to EAEU Treaty
Tengrinews.kz — Kazakh entrepreneurs will be able to participate in public procurement in other Eurasian Economic Union (EAEU) countries without having to obtain bank guarantees abroad. The corresponding amendments to the EAEU Treaty were approved today by Kurultai deputies.
Lawmakers considered a draft law on the ratification of a protocol amending the Treaty on the Eurasian Economic Union dated May 29, 2014.
The document was signed by the heads of EAEU member states in Moscow on July 28, 2025. It contains 30 amendments covering the internal market, public procurement, technical regulation, trade in services, competition, the electric power sector and transport.
Note: The Eurasian Economic Union (EAEU) is an international organization for regional economic integration created to ensure free trade and the free movement of goods, services, capital and labor between member states. The union has operated since 2015 on the basis of a common customs area and coordinated economic policy. The EAEU consists of five countries: Kazakhstan, Russia, Belarus, Armenia and Kyrgyzstan.
What will change for Kazakh businesses
One of the key changes concerns the mutual recognition of bank guarantees for participation in public procurement.
“The protocol establishes mutual recognition of bank guarantees, which will allow domestic entrepreneurs to enter the public procurement markets of EAEU member states with a guarantee issued by a Kazakh bank. Previously, guarantees from banks in other EAEU member states were required,” Minister of Trade and Integration Arman Shakkaliyev said.
This means that once the relevant amendments take effect, Kazakh companies will no longer need to apply to foreign banks for guarantees in order to participate in public procurement in other EAEU countries.
What other changes are included
According to Arman Shakkaliyev, the amendments also clarify the powers of the Eurasian Economic Commission. In particular, the Commission will be able to approve the methodology for identifying obstacles in the EAEU internal market and recognizing barriers as removed.
The amendments also propose removing duplicate provisions on exchanging information about the payment of import customs duties, since such information exchange is already provided for under the EAEU Customs Code.
In the area of competition, the procedure for compulsory enforcement of Eurasian Economic Commission decisions will be clarified, taking into account the legislation of each country.
Outdated provisions and terms will also be removed from the treaty.
Deputies considered the draft law in two readings and voted to adopt it.
Earlier, Kazakh lawmakers supported the ratification of a protocol amending the Treaty on the Eurasian Economic Union. At that time, the changes concerned financial support for joint industrial cooperation projects implemented by EAEU member states.
